German Supply Chain Act - LkSG - §17 Obligation to provide information and hand over documents

(1) Companies and persons summoned in accordance with Section 15, Sentence 2, Number 1 shall be obliged to provide the competent authority, upon request, with such information and to surrender such documents as the authority may require in order to perform the duties assigned to it by or on the basis of this Act. The obligation shall also extend to information on affiliated companies (Section 15 of the German Stock Corporation Act), direct and indirect suppliers and the handing over of documents of these companies, insofar as the company or person obliged to provide information or hand over documents has the information at its disposal or is in a position to obtain the information requested on the basis of existing contractual relationships.
(2) The information to be provided and documents to be surrendered pursuant to paragraph 1 shall include in particular
1. the information and evidence to determine whether an enterprise falls within the scope of this Act,
2. the information and evidence on the fulfillment of the obligations under sections 3 to 10 (1), and
3. the names of the persons responsible for monitoring the company's internal processes for the fulfillment of the obligations pursuant to Sections 3 to 10 (1).
(3) Any person required to provide information pursuant to subsection 1 may refuse to provide information in response to questions the answer to which would expose him or her or any of the relatives referred to in section 52(1) of the Code of Criminal Procedure to the risk of criminal prosecution or proceedings under the Code of Administrative Offences. The person obliged to provide information shall be informed of his or her right to refuse to provide information. Other statutory rights to refuse to provide information or to make statements and statutory duties of confidentiality shall remain unaffected.
