German Supply Chain Act - LkSG - §14 Official action
Regulation authorization
(1) The competent authority shall act:
1. ex officio at its due discretion,
a) to ensure compliance with the obligations under sections 3 to 10 (1) with regard to possible human rights-related and environmental risks
as well as violations of a human rights-related or an environment-related duty, and
(b) to detect, remedy and prevent violations of obligations under subparagraph (a);
2. upon request, if the person making the request substantiates,
(a) that a protected legal position has been violated as a result of the failure to comply with a duty contained in sections 3 to 9; or
(b) that a violation referred to in subparagraph (a) is imminent.
(2) The Federal Ministry of Labor and Social Affairs is hereby authorized, by ordinance in agreement with the Federal Ministry of Economics and Energy, to
and Energy without the consent of the Bundesrat to regulate in more detail the procedure for risk-based monitoring pursuant to subsection 1 and sections 15 to 17.
